By accessing or using StyleSwipe (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

StyleSwipe (Pty) Ltd reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

You may use StyleSwipe for personal, non-commercial fashion discovery purposes only. You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the Service; (c) scrape, crawl, or otherwise extract data from the Service in bulk; or (d) interfere with or disrupt the integrity or performance of the Service.

StyleSwipe reserves the right to suspend or terminate your access to the Service at any time for any violation of these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify StyleSwipe immediately of any unauthorised use of your account.

You must be at least 13 years of age to create an account. By creating an account, you represent and warrant that you meet this age requirement.

By uploading images or other content to StyleSwipe (“User Content”), you grant StyleSwipe a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display such content solely for the purpose of providing the Service.

You represent and warrant that you own or have the necessary rights to the User Content you upload, and that your User Content does not violate any third-party rights or applicable laws.

StyleSwipe reserves the right to remove any User Content that violates these Terms or that we consider objectionable in our sole discretion.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

The Service may contain links to third-party websites or services, including retail partners such as Superbalist, Mr Price, Woolworths, and others. StyleSwipe is not responsible for the content, privacy practices, or terms of service of these third-party services.

Your interactions with third-party retailers are governed by those retailers' own terms and policies. StyleSwipe does not guarantee availability, pricing, or the accuracy of product information displayed from third-party sources.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, STYLESWIPE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

StyleSwipe does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated fashion recommendations are provided for informational purposes only and do not constitute professional styling advice.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STYLESWIPE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF STYLESWIPE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

StyleSwipe's total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to StyleSwipe in the twelve months preceding the claim, or (b) R500.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, including the Protection of Personal Information Act, 2013 (POPIA) and the Electronic Communications and Transactions Act, 2002 (ECTA).

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

As a South African company, StyleSwipe is committed to compliance with POPIA in all processing of personal information. Our designated Information Officer can be contacted at privacy@styleswipe.co.za.

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Service or by sending an email to the address associated with your account. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance.
